Serbia refuses to apply provisions of Protocol I additional to the Geneva Conventions

8th of June 2017 marks the 40th anniversary of the adoption of Protocol I additional to the Geneva Conventions, which prescribes the responsibility of a commander to prevent the commission of crimes and punish the perpetrators.

Article 87, paragraph 3 of the Protocol: „The High Contracting Parties and Parties to the conflict shall require any commander who is aware that subordinates or other persons under his control are going to commit or have committed a breach of the Conventions or of this Protocol, to initiate such steps as are necessary to prevent such violations of the Conventions or this Protocol, and, where appropriate, to initiate disciplinary or penal action against violators thereof.” Protocol I had been incorporated into national military legislation already back in 1988. Although there is legal basis, no one has ever been prosecuted for command responsibility in Serbia for crimes committed during the wars in the former Yugoslavia.

The Humanitarian Law Center (HLC) filed a number of criminal complaints against commanders in whose areas of responsibility crimes had been committed. Apart from opening an investigation in the case of Dragan Živanović, HLC’s criminal complaints have been ignored. Not a single high-ranking person has been prosecuted by the Office of the War Crimes Prosecutor of Serbia in 13 years since the beginning of its work.

Report on Material Reparation for 2012 Presented

On Wednesday, June 13th, 2013, the Humanitarian Law Center (HLC) presented its report on material reparation for the year 2012, titled “Fulfilling the Right for Victims of Human Rights to Seek Reparation Before Serbian Courts – Serving Justice or Trivializing Crimes”. Tanja Drobnjak, an HLC attorney, who represents victims in lawsuits against the state of Serbia, Petar Žmak, Reparation Project Coordinator at the HLC, Dr. Saša Gajin from the Faculty of Law at Union University, and Senad Jusufbegović, a former prisoner at the Šljivovica and Mitovo Polje camps, spoke at the conference. Sandra Orlović, the Executive Director of the HLC, was the Moderator.

Film ‘Education for Reconciliation’

‘Education for Reconciliation’ is a film produced by the Humanitarian Law Center (HLC) on the Regional School for Transitional Justice, organized in January 2013, for 25 participants from Bosnia and Herzegovina, Kosovo and Serbia by HLC, HLC Kosovo and Association Pravnik from B&H. Participants attended a ten-day intensive programme on judicially established facts and war crimes trials, truth commissions, reparations for victims of violence, institutional reforms, roles of media and archives in post-conflict societal reconstruction, and other strategies to achieve reconciliation after a violent conflict. Among the lecturers at the School are most prominent regional experts on transitional justice, culture of memory, rule of law in post-conflict societies, etc. Film ‘Education for Reconciliation’ follows several students of the School, their impressions on the content of the lectures and personal changes they had undergone while being exposed to topics of the School.

Debate Held on War Crimes Trials in Serbia

A debate on war crimes trials in Serbia was held on Thursday, January 17th, 2013 in the Media Center in Belgrade. The Humanitarian Law Center (HLC) organized the debate anent the presentation of its Report on War Crimes Trials in 2012. Representatives of the Office of the War Crimes Prosecutor (OWCP), the Higher Court in Belgrade, the Court of Appeals in Belgrade, representatives of the OSCE, EULEX, the Office for Human and Minority Rights, the Higher Courts in Niš and Prokuplje, Embassies, the Ministry of Justice and the state administration, and of non-governmental organizations attended the debate.

Report from the Debate on War Crimes Trials in Serbia

A debate on war crimes trials in Serbia was held on Friday April 27th, 2012 in the Media Centre in Belgrade. The reason for organizing this debate was the Report on War Crimes Trials in Serbia in 2011 published by the Humanitarian Law Center (HLC). Representatives of the Office of the War Crimes Prosecutor, the Higher Court in Belgrade Department for War Crimes, the Court of Appeals in Belgrade, the courts from all over Serbia, attorneys, representatives of civil society, and representatives of embassies participated in the debate.
