An international tribunal is creating confusing standards on war crimes and politicians
THROUGHOUT the brutal wars that tore apart the former Yugoslavia in the 1990s, Vojislav Seselj was a leading proponent of ethnic cleansing. An ultra-nationalist backer of a Greater Serbia, who recruited an infamously cruel and thuggish militia to help create it, for the past seven years Mr Seselj has been on trial for war crimes before the International Criminal Tribunal for the Former Yugoslavia in The Hague. On March 31st, the tribunal found Mr Seselj innocent on all charges. The verdict came one week after the same tribunal convicted Radovan Karadzic, the wartime leader of the Bosnian Serbs, on charges of murder, extermination and genocide. The Seselj verdict has sent shock waves through the Balkans. The judges’ reasoning may have broad ramifications for international justice.
On March 31st, 2016, the Trial Chamber of the International Criminal Tribunal for the Former Yugoslavia (ICTY) delivered its first instance judgment acquitting the President of the Serbian Radical Party (SRS), Vojislav Šešelj, of criminal responsibility on all counts of the indictment, with the dissenting opinion of one member of the Trial Chamber expressing criticism of the judgement in harsh tones. The Humanitarian Law Center (HLC) holds that the acquittal is based on findings which are in contradiction to the practice of the ICTY, as well as on an unsustainable reinterpretation of events which occurred during the wars, which is offensive to the victims.

Genocide, persecution, extermination: Radovan Karadžić was finally found guilty and sentenced, though parts of the ruling disappoint the victims.
The verdict disappointed both the victims and the defence. Vasvija Kadić, of the association Mothers of Srebrenica, described the conviction of Radovan Karadžić to 40 years rather than life imprisonment as “shameful” and “offensive”. Milomir Savičić, president of the association of veterans of Republika Srpska, called the verdict “unfair”, while defence lawyers were announcing an appeal.
