HLC Opinion: ICTY Appeals Chamber Grants Šljivančanin’s Request for Review of Judgment on the Basis of Biased Witness’ Testimony

The Humanitarian Law Center, who represented the families of those persons executed at Ovčara before the War Crimes Chamber of the Belgrade District Court (hereinafter the War Crimes Chamber), believes that the ICTY Appeals Chamber gave undo trust  to a witness in the case.

FHP-OR-030 FUND: A Time When People Spoke – Echoes and Reactions

PERIOD: 1988-1991

PRIMARY SOURCE: Politika Daily newspaper

VOLUME AND MEDIUM: 1 CD

CONTENT: ‘How People Spoke’ represents edited material from the  ‘Echoes and Reactions’ column, which was published in the Politika daily newspaper from July 1988 until March 1991, in which Politika’s readers were at the same time authors of articles in which they presented their opinions and reactions to the news published in Politika’s columns relating to internal, foreign, cultural and sports affairs.

The ‘Echoes and Reactions’ column is of essential significance for an understanding of the manner in which the public in Serbia and those parts of Yugoslavia inhabited by Serb populations was systematically prepared for the   directed future deconstruction of the country and the wars in Slovenia, Croatia, Bosnia and Herzegovina, and, finally,  Kosovo. Ten years after the sudden end which was as sudden as the beginnings (July 1988 – March 1991), the column remains in the memory of contemporaries  as a symbol of the political instrumentalization of the media for the purpose of an orchestrated manipulation of the public, a testimony to the professional downfall of the editors of Politika, a very influential daily newspaper; and also as an indelible record of the dishonourable role of intellectuals in the development and rationalization of ethnic stereotypes, incitement to national hatred and  revision of history. This was a preparation for much more serious political and military undertakings that followed.

FUND: FHP-CU-028 Court files from trials of members of the 177th Platoon of the Peć Military Territorial Detachment of the Yugoslav Army for war crimes against prisoners of war in the village of Ćuška in Kosovo

PERIOD: 2011-2012

PRIMARY SOURCE: War Crimes Chamber of the District Court in Belgrade, Republic of Serbia.

VOLUME AND MEDIUM:  2 archival boxes.

CONTENT:  The Fund contains documents and transcripts from trials of members the Yugoslav Army Peć Military Territorial Detachment 177th Platoon, namely, the trials of Toplica Miladinović, Srećko Popović, Slaviša Kastratović, Boban Bogićević, Zvonimir Cvetković, Radoslav Brnović, Vidoje Korićanin, Veljko Korićanin, and Abdulah Sokić, because they committed the war crimes of murder, persecution and looting of the Albanian civilian population in the villages of Ćuška, Zahać and Plavljan.

FHP-BY-029 FUND: Court files from the trial of members of the Serbian Ministry of the Interior, for the war crime against prisoners of war in Petrovo selo, Serbia

PERIOD: 2009-2010

PRIMARY SOURCE:  War Crimes Chamber of Belgrade District Court,  Republic of Serbia.

VOLUME AND MEDIUM:  2 archival boxes.

CONTENT:  Sreten Popović and Miloš Stojanović, members of the Serbian Ministry of the Interior, were charged with the fact that in July 1999 in Petrovo Selo, Serbia, they deprived members of the Atlantic Brigade in the KLA armed services volunteer unit in Kosovo, Ali, Agron and Mehmet Bytiqi, of the right to regular and fair trial, and then  killed them by execution.

The fund contains court documents (records of  the examination of the defendants and witnesses, official notes, court experts’ reports) and transcripts from trials.

FHP-LV-0027 FUND: Court files, from trials of members of paramilitary formations and JNA soldiers, for Crimes Committed Against Civilians in Lovas

PERIOD: 2008-2012.

PRIMARY SOURCE:  War Crimes Chamber of Belgrade District Court.

VOLUME AND MEDIUM:  13 archival boxes.

CONTENT: Documents containing transcripts from the trials of Ljuban Devetak, Milan Devčić, Milan Radojčić and Željko Krnjajić, members of  Territorial Defence and the de facto  civilian and military government established in the Municipalities of Lovas and Tovarnik, as well as transcripts from the trials of Jovan Dimitrijević, Saša Stojanović, Dragan Bačić, Zoran Kosijer and Aleksandar Nikolaidis, members of the Dusan the Mighty volunteer armed group, and of members of  Territorial Defence units from Valjevo, Miodrag Dimitrijević, Darko Perić, Radovan Vlajković and Radislav Josipović, who launched an attack against the civilian population of Croatian nationality in Lovas in 1992.

FHP-SB-007 FUND: Court documents from trial of members of the Republic of Srpska Army for Crimes against Civilians in Srebrenica

PERIOD:1995-2003.

PRIMARY SOURCE: Government of the Republic of Srpska, Ministry of the Interior of Bosnia and Herzegovina, ICMP, ICTY, ICRC

VOLUME AND MEDIUM:  2 archival boxes

CONTENT: The documents are split into two parts, according to sources. One part of the documents is composed of lists of missing persons and exhumation reports made during the work of international organizations relating to the search for the missing (ICMP, ICRC, ICTY). The second part encompasses witness statements, reports on the transfer of prisoners of war, records on the transfer of persons, official notes made during the implementation of the decision by the Republic of Srpska Government and the Bosnia and Herzegovina Ministry of the Interior to conduct an investigation into the events in Srebrenica in 1995.

FHP-SP-016 FUND: Representation of political parties and presidential candidates in electronic and printed media in Serbia

PERIOD: 1997

PRIMARY SOURCES: Radio Television of Serbia, Studio B, Politika (daily newspaper), Naša Borba  (daily newspaper)

VOLUME AND MEDIUM:  2 archival boxes

CONTENT: During the electoral campaign for the 1997 Presidential Elections in Serbia, the Humanitarian Law Center researchers followed the broadcasts from the Radio Television of Serbia and Studio B, and the printed media, including Politika, Blic, and Naša Borba. The documents contain the analysis of the media appearances of the presidential candidates, with a special focus on direct and concealed propaganda and hate speech, and an overview on the extent of success of the equal presentation of candidates and parties as one of the main prerequisites of a free and democratic electoral process.

PRIMARY SOURCES: Family members whose property was forcibly confiscated and who were displaced from the territory of Kosovo and Bosnia and Herzegovina.

VOLUME AND MEDIUM:  40 archival boxes

CONTENT: The Fund contains statements given by injured parties relating to the circumstances under which their movable and immovable property was confiscated; and they  are accompanied by various documents proving the right to the confiscated  property – personal identification cards, temporary residence registrations, agreements on exchange of real estate, decisions on modifications made in the cadastre, apartment lease agreements, apartment allocation decisions, copies of passports, court certificates, agreements on purchasing real estate, certificates of property rights registration requests, contracts on maintenance for life, title deeds, displaced persons’ identification documents,  decisions on paying fees for construction lots, records on evaluation of housing units, the gift of real estate agreements, copies of plans, copies of  certificates of title, decisions on permit to build an outhouse, official surveyor’s certificates.
