General Provisions
These Terms of Use regulate the rights and obligations related to using the Platform (website) on the domain www.hlc-rdc.org (hereinafter referred to as the “Platform”).
These Terms of Use form an integral part of the Platform and constitute an electronic agreement. Users cannot alter its provisions but can only accept them as prescribed by the Platform owner, an agreement on the provision of information society services, concluded between:
- The owner of the Platform (HLC) and
- The user of the Platform.
General Definitions
Article 1.
Platform—The software presented on the Humanitarian Law Center’s website (URL: http://www.hlc-rdc.org/).
Owner of the Platform – This Platform and domain are the property of the Humanitarian Law Center Foundation (HLC), Braće Jugovića 2a, Belgrade, Serbia, registration number 06421458.
User of the Platform – Any person who accesses the Platform and thereby uses it, regardless of whether they perform any actions on it.
The function and services of the Platform are informational.
Introductory Provisions
Article 2.
Free access to the Platform is guaranteed to all.
The Platform is available to individuals in the manner and under the conditions described in these Terms of Use, under which the information society service is provided.
The integrity of the Platform means that HLC retains the right to modify or discontinue (temporarily or permanently) any element of the Platform, the services it provides, and related content and entries.
Subject and Purpose
Article 3.
The subject of the agreement is the conditions under which individuals may access and use this Platform and its services, as well as the relationship between HLC and the users of the Platform. The purpose of the Platform is to provide users with information about HLC’s activities, which aim to assist post-Yugoslav and other post-conflict societies in establishing the rule of law and addressing the legacy of mass human rights violations to determine criminal responsibility for perpetrators, ensure justice, and prevent the recurrence of war crimes. The purpose of the Platform is also to provide information and data on socially significant events and processes, as well as the activities of domestic and international institutions, non-governmental organizations, media, and other actors related to HLC’s areas of engagement.
Functioning of the Platform
Article 4.
Access to the Platform is equally available to all. Each access to the content and functions of the Platform is subject to these Terms of Use. Users may use the Platform to collect information and access reports, dossiers, publications, the library, podcasts, blogs, and other content created by HLC, as well as publicly available content collected and made accessible by HLC. Materials may be downloaded for educational and non-commercial purposes, provided the source is cited, and HLC is credited as the copyright holder.
All materials on the Platform are the property of HLC, which holds exclusive, permanent, and unrestricted copyright and authorizations, including publishing, reproduction, distribution, public communication in all forms, printing and online publishing, translation into other languages, editing and proofreading, and promotion.
The operation of the Platform is primarily regulated by the Law on Electronic Commerce, Law on Obligations, Law on Advertising, Law on Copyright and Related Rights, Law on Trademarks, Law on Personal Data Protection, as well as other regulations of the legal system of the Republic of Serbia in areas not covered by the aforementioned laws. The Platform is committed to protecting personal data rights and enforcing copyright protection in accordance with IT security standards, ethical business practices, and applicable laws of the Republic of Serbia.
Obligations of the Platform Owner
Article 5.
HLC ensures the Platform’s functionality and thereby enables users to use it. HLC is obligated to respect users’ Terms of Use and privacy.
Obligations of Platform Users
Article 6.
Each user is required to use the Platform in accordance with its purpose and the Terms of Use they have agreed to or accepted.
Each Platform user is responsible for keeping their data secure and accepts responsibility for all activities they perform.
Non-Discrimination Clause
Article 7.
The Platform provides all interested individuals access to the information it offers without discrimination, either direct or indirect, on any grounds, especially on the grounds of race, gender, national origin, social background, birth, religion, political or other beliefs, property status, culture, language, age, and mental or physical disability.
Liability
Article 8.
The Platform is not a substitute for professional consulting services or any other services not listed in these Terms, nor does the Platform provide or guarantee any other services other than the described information society service.
Termination of the Agreement
Article 9.
This agreement is concluded for an indefinite period.
This agreement applies only to the user’s visits to and activities on the Platform. Agreement termination is not required; it ends simply by not using the Platform.
Change of Terms of Use
Article 10.
HLC may change the Platform Terms of Use. This does not constitute a new agreement or an amendment to the existing one, but users will need to accept the new version upon their next access to the Platform. Users can accept the Terms of Use in the new form actively. If they do not accept them, they will not have access to the full content of the Platform.
Personal Data Protection
Article 11.
The Platform ensures the protection of personal data by the Personal Data Protection Act and the Privacy Policy below.
Privacy Policy
This document represents the official Privacy Policy of the Humanitarian Law Center’s website (www.hlc-rdc.org) (hereinafter referred to as the Platform).
Article 1.
In accordance with the Law on Personal Data Protection (“Official Gazette of the RS” No. 87/2018), the owner of the Platform, the Humanitarian Law Center Foundation (hereinafter HLC), Braće Jugovića 2a, Belgrade, Serbia, ID number 06421458, hereby establishes this Privacy Policy.
The Privacy Policy constitutes a contract upon access, which is concluded between HLC and the platform user at the moment of access. The individual’s active action accepts the Privacy Policy, thereby confirming that they have read and understood it and agreed to it.
The agreement and your consent are the legal basis for data collection.
Data We Collect via the Website
Article 2.
When using the Platform, the following data may be automatically collected:
- Internet Protocol address of your device, type, and version of your browser, pages you visited on the Platform, time and date of your visit to the Platform, time spent on those pages, unique device identifiers, and other diagnostic data.
If you access the Platform through your mobile device, certain information may be automatically collected, including (but not limited to) the type of your mobile device, its IP address, the operating system type, the internet browser type used on your mobile device, unique device identifiers, and other diagnostic data.
HLC may also collect information your browser sends each time you visit the Platform.
If you decide to subscribe to the HLC newsletter, HLC collects:
- User data – optional: organization name, location;
- User’s email address – mandatory;
- User’s first and last name – mandatory.
Purpose of Data Collection
Article 3.
The purpose of collecting the data in Article 2 is to enable access to the Platform and to provide the option of receiving information in the form of a newsletter sent to the user’s email address.
Data Protection
Article 4.
The collected data is stored electronically in databases that only a limited number of individuals within HLC can access. The electronic system is protected by antivirus software.
The hosting company is obligated to treat personal data it comes into contact with in connection with the Platform in the same manner as HLC treats this data.
In case of a significant threat to data or an increased risk to data, such as data leakage, hacking, or database theft, HLC will notify the Commissioner for Information of Public Importance and Personal Data Protection.
If HLC suspects unauthorized access to its computer devices, HLC will change passwords as quickly as possible and take any other necessary measures to prevent future activities that compromise the security of personal data.
Data Retention Period
Article 5.
Personal data will not be retained longer than necessary to fulfill the purpose for which it was processed. HLC will retain data within the legal retention period.
After the purpose is fulfilled or after the expiration of the legally prescribed retention period, the data will be permanently deleted.
In certain cases, personal data may be stored for a longer period to fulfill legal obligations or to establish, exercise, or defend against legal claims, in accordance with applicable laws.
Any individual can request the deletion of their data at any time.
Links (Backlinks)
Article 6.
The Platform may contain links to other websites that are not under the control of HLC and are not subject to this Privacy Policy. If you access other websites through the provided links, the operators of those websites may request information from you that will be used in accordance with their privacy policies, which may differ from HLC’s Policy.
Cookies
Article 7.
The Platform uses cookies to improve the user experience. A notice regarding this will appear to new users upon their first visit to the site, and they can accept the use of cookies through an active action. You can access HLC’s cookie policy here.
Automated Decision-Making and Profiling
Article 8.
HLC does not make decisions or conduct profiling automatically.
Transfer of Data to Third Parties
Article 9.
HLC does not transfer data to third parties, either domestically or internationally, except with the individual’s explicit consent or in exceptional, legally prescribed situations, without the individual’s permission. Data may be transferred and stored on computers located outside Serbia, provided they are stored in a country that adheres to GDPR rules and principles. Personal data will only be shared with public authorities when required by law.
In the event of a transfer of HLC’s rights, the databases and the Platform will be transferred to the acquiring entity. However, the acquiring entity will be bound by
all previously signed agreements that HLC had with its users, including these Terms of Use and this Privacy Policy.
Rights of Data Subjects
Article 10.
Individuals whose data is processed through the website have the following rights regarding personal data protection:
Right to Information – The right of individuals to be informed about their rights, obligations, and matters related to processing their personal data in accordance with the Personal Data Protection Law (PDPL), even before the processing begins.
Right of Access – The right of individuals to request that HLC provide access to their personal data, including the right to determine the subject, method, purpose, and scope of data processing, as well as to ask questions regarding the processing itself.
Right to Rectification and Completion – After reviewing their data, individuals have the right to request HLC to correct, complete, or update the processed personal data.
Right to Erasure – Individuals can request HLC to delete their personal data in accordance with the PDPL, as well as to stop or temporarily suspend processing.
Right to Withdraw Consent for Processing – In cases where the legal basis for processing personal data is the individual’s consent, that individual has the right to withdraw their consent at any time in writing.
Right to Restriction of Processing – In accordance with the PDPL, individuals have the right to request that the processing of their personal data be restricted.
Right to Data Portability – The data subject has the right to request the transfer of personal data to another data controller when technically feasible, i.e., when the personal data subject to the transfer request is in a structured and machine-readable format.
Right to Object and Automated Individual Decision-Making – If the data subject believes it is justified based on their specific situation, they have the right to object at any time to the processing of their data by HLC. Additionally, they have the right not to be subject to a decision based solely on automated processing, including profiling, if such a decision produces legal effects concerning them or significantly affects their position.
The data subject has the right to oppose the processing of their personal data for direct marketing purposes and to request restrictions on processing in certain other cases.
If HLC intends to further process personal data for a purpose different from the one for which the data was collected, it is obliged to provide the data subject with information about this new purpose, as well as all relevant information in accordance with their right to be informed.
Personal Data Protection Mechanisms
Article 11.
The personal data protection mechanisms available to any individual who believes their data has been compromised or violated include both internal and external mechanisms. The internal mechanism involves reporting to the person responsible for personal data protection within the entity that owns the Platform, while the external mechanism involves seeking protection from the relevant state authority.
In case of any personal data breach, the website user has the right to contact the person responsible for personal data protection via email at office@hlc-rdc.org.
Suppose the data subject is not satisfied with HLC’s response to their request regarding personal data protection rights. In that case, they have the right to file a complaint with the competent authority, the Commissioner for Information of Public Importance and Personal Data Protection, at Bulevar Kralja Aleksandra 15, 11000 Belgrade, Republic of Serbia.
Changes to the Privacy Policy
Article 12.
HLC reserves the right to amend this Privacy Policy at any time deemed appropriate, with all changes taking effect on the day of publication. You will be appropriately notified of any significant changes.
Court Jurisdiction
Article 13.
For any disputes arising from these Terms of Use and this Privacy Policy, the competent Belgrade, Serbia court shall have jurisdiction.
